Enterprise Terms of Service

1. Acceptance of Terms
By accessing or utilizing the API, SDKs, runtime endpoints, documentation, or developer portal provided by Apexsions AI Inc. ("Apexsions", "Platform"), you ("Customer" or "Developer") enter into a legally binding contract governed by these Terms of Service.
2. Service Provision & API Availability
Apexsions grants you a non-exclusive, non-transferable, revocable license to integrate and deploy autonomous agent runtimes in digital entertainment, virtual worlds, and software applications. We target a 99.9% uptime SLA for Developer tier and 99.99% for Growth and Enterprise tiers.
3. Acceptable Use Policy
Customers agree not to utilize the Platform to:
- Generate hateful, discriminatory, or harmful content violating Anthropic's Usage Policies.
- Attempt reverse engineering, model distillation, or extraction of weights from upstream inference providers.
- Conduct denial-of-service (DoS) or automated stress testing against public API conduits without prior authorization.
- Deploy unauthorized surveillance or deanonymization agents on unsuspecting end-users.
4. Intellectual Property & Customer Ownership
Your Data & Output: As between you and Apexsions, you retain all ownership, intellectual property rights, and title to your custom world canon, character scripts, game states, and the generated conversational outputs produced by the model.
The Platform: Apexsions retains all intellectual property in the runtime engine, SDK source code, vector orchestration algorithms, and proprietary guardrail architectures.
5. Token Accounting, Subscriptions & Quotas
API consumption is metered per token processed (both input prompt tokens and output completion tokens). Monthly billing plans renew automatically unless cancelled via the developer console before the billing anniversary. Unused monthly allocations do not roll over.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEXSIONS AI INC. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM SYSTEM LATENCY, NETWORK INTERRUPTIONS, OR UPSTREAM MODEL OUTAGES.
7. Governing Law & Jurisdiction
These Terms are governed by and construed under the laws of the State of California, United States, without regard to its conflict of law principles.
